Please note that Black Market collects, uses and retains information regarding visitors to the site and products purchased for the following purposes:

Where possible, we will collect your personal information directly from you. In some instances we may collect personal information about you from someone else. For example, someone may give us your name and address if they have purchased a gift voucher for you and ask that we send the gift voucher to you. If you provide us with personal information of another individual, you agree to take reasonable steps to ensure that the individual is made aware of this Privacy Policy.

You have the right under the Privacy Act 2020 to access any personal information held about you and to request correction of the blackmarket.co.nz database. If so requested we may make the requested correction or attach a note to the record stating that a request for correction was made but not acted upon.

You can also request deletion of any personal information. Where you require deletion of personal information that is essential to providing our services and/or our suppliers services this may entail deactivation of your user account and disabling your ability to place orders.

New members are requested to provide proof of age documentation to Black Market to authorise a new Black Market account. Proof of age documentation is used for no other purpose than to verify the age of the purchaser.

By placing an order for product through the site you are also expressly authorising Black Market to provide your details as entered on the site (including without limit your name, address, phone numbers and credit card details, as applicable) to:

(a) suppliers so they can process and fulfil orders you have placed with them for products and arrange for the delivery of those products to you;

(b) a trusted payment services provider for the purpose of processing your payment. You will have the option to choose to allow us to store your credit card or other payment account information at the time of payment. If you elect not to store your credit card or other payment account information you will need to resubmit this information for each purchase made on the site. (c) our other third-party service providers to assist us in processing and delivering your order (for example, couriers).

(d) third-party service providers who may send updates to assist you in managing/completing your orders.

We reserve the right to decline to add you to our database at any time, to remove your details from our database at any time and/or to block you from accessing the site at any time at our sole discretion.

Users who login have their IP addresses recorded. This information will only be provided to legal authorities in cases of suspected fraud or for law enforcement purposes. This information is stored securely and will not be provided to other members or non-authorised parties.

Where you submit or post any comment or material on the site (including but not limited to reviews and user comments), it becomes the property of blackmarket.co.nz. Your first name as entered by you in your account details only (i.e. not your surname) will be used beside the post. If you select to upload your photo, it will appear with your comments also. It will also appear briefly under the "just purchased" section with your first name only.

You agree that any such comment or material (together with your first name only) can be used, displayed, reproduced, or published by us in any and all media or distribution platforms including but not limited to Twitter, Facebook and Instagram, for an unlimited period and for any reason including but not limited to existing and future promotional, marketing or publicity purposes. Other than as set out in these terms your information will not be made available to any other organisation except as required by law.
